The Domino’s Smart Forecast Model is an optional Pulse System feature that is only available to franchisees that have affirmatively elected to enable it in their PWR System and have submitted the information required by this form above. Domino’s Pizza LLC and its affiliated entities do not require the use of this optional feature, and whether a franchisee chooses to use the feature will have no bearing on the evaluation of a store’s performance. As independent business owners, franchisees must decide, in their sole discretion, whether to use this optional feature to help them project future store sales and generate general estimates of labor hours that may be needed based on those projected sales. This optional feature is only as accurate as the information franchisees elect to input into their Pulse System. Further, because this feature generates projections, there is no assurance or guarantee that the information it provides will be the best information for a particular franchisee’s store. Franchisees who elect to use this optional feature must ultimately determine whether to vary from the general estimates this feature generates based upon their own circumstances, including circumstances that may be unique to their store, such as weather, local events, and consumer preferences. Franchisees must also determine which of their individual employees to schedule during particular shifts and any schedule modifications that may be necessary before or during particular shifts.

The information this optional feature generates should not be used for payroll purposes. Franchisees must determine the policies, procedures, and practices that need to be implemented in their stores to ensure that their operations and practices comply with applicable federal, state, and local laws. Franchisees are solely responsible for the operation of their stores including, without limitation, employment and pay practices, safety and security matters, and other workplace issues. The persons who work in stores owned and operated by franchisees are employees of the franchisees only; they are not employees of Domino’s Pizza LLC or its affiliated entities.
